In 2006, after a decade of effort by many individuals and organizations, the legislators of the 495/MetroWest delegation, led by state Senator Karen Spilka, were successful in securing the statutory reforms necessary to allow communities served by the MBTA to start a new Regional Transit Authority (RTA) or join an existing RTA.

The 495/MetroWest Corridor experienced the greatest change in population growth in the Greater Boston region between 1990 and 2000. At the same time, communities within this region had a 69 percent gain in employment. The increased land use challenges caused by this employment and population growth have added to increased traffic and congestion.

The "typical" commute is no longer from the suburbs into a central city. Suburb to suburb travel is becoming the dominant commuting pattern. In fact, 57 percent of residents commute to employment centers within the 495/MetroWest Corridor Partnership 32 community region. As a result, suburban communities in the I-495/MetroWest region have developed a pressing need for more comprehensive transit services.

3.      Create a seamless public transportation system throughout the MetroWest communities.

A.   Work with member communities to facilitate inter-community transit services.

B.   Engage public in determining transit design.

Complaint Process

The MWRTA is committed to providing safe and reliable service to all our customers. We value all comments/concerns as a way to continue to improve service.

 ·       How is a complaint filed?

A complaint can be filed either by calling our main customer service line at 508-935-2222 or by email at info@mwrta.com. You may also write directly to the MWRTA at 37 Waverley Street, Framingham, MA 01702, Attn: Customer Service.

The customer should provide details of the incident as well as the date, time, driver/vehicle and any other specifics that would assist the MWRTA in determining an appropriate resolution. Customer Contact information including, name, address and phone # should be given at this time.

 ·       What happens after the complaint is registered?

The MWRTA takes every customer complaint seriously. It will be forwarded to the proper supervisor and result in a timely resolution.  The customer may be contacted if additional information is necessary in order to make a determination. The customer will be notified when a resolution is determined.

 ·       What if the complaint resolution is not considered satisfactory to the customer?

The customer has the option to contact the Administrator in writing within 10 days of the resolution determination. The Administrator will evaluate the determination and make his decision on whether any further action is necessary. The Administrator's decision is final.

DISADVANTAGED BUSINESS ENTERPRISE PROGRAM

FOR FISCAL YEAR 2009

 

POLICY STATEMENT

 

Objectives/Policy Statement

 

The MetroWest Regional Transit Authority (MWRTA) has established a Disadvantaged Business Enterprise (DBE) program in accordance with regulations of the U.S. Department of Transportation (DOT), 49 CFR Part 26.  The MWRTA has received Federal financial assistance from the Department of Transportation, and as a condition of receiving this assistance, the MWRTA has signed an assurance that it will comply with 49 CFR Part 26.

 It is the policy of the MWRTA to ensure that DBE’s as defined in part 26, have an equal opportunity to receive and participate in DOT–assisted contracts.  It is also our policy:

 

1.     To ensure nondiscrimination in the award and administration of DOT – assisted contracts;

2.     To create a level playing filed on which DBE’s can compete fairly for DOT-assisted contracts;

3.     To ensure that the DBE Program is narrowly tailored in accordance with applicable law;

4.     To ensure that only firms that fully meet 49 CFR Part 26 eligibility standards are permitted to participate as DBE’s;

5.     To help remove barriers to the participation of DBE’s in DOT assisted contracts;

6.     To assist the development of firms that can compete successfully in the market place outside the DBE Program.

 

Ms. Eva Willens of MWRTA has been delegated as the DBE Liaison Officer.  In that capacity, Ms. Willens is responsible for implementing all aspects of the DBE program.  Implementation of the DBE program is accorded the same priority as compliance with all other legal obligations incurred by the MWRTA in its financial assistance agreements with the Department of Transportation.

          Ms. Willens has disseminated this policy statement to the MWRTA Advisory Board and all of the components of our organization.  She is responsible for distributing this statement to DBE and non-DBE business communities that perform work for us on DOT-assisted contracts by including a policy statement in all procurement documents, advertising the DBE policy in public announcements, and by making the DBE plan available to the public by placing it on the MWRTA website.

SUBPART A – GENERAL REQUIREMENTS

Section 26.1                 Objectives

 The objectives are found in the policy statement on the first page of this program.

 Section 26.3                 Applicability

 The MWRTA is the recipient of federal transit funds authorized by Titles I, III, V, and VI of ISTEA, Pub. L. 102-240 or by Federal transit laws in Title 49, U.S. Code, or Titles I, II, and V of the Teas-21, Pub. L. 105-178.

 Section 26.5                 Definitions

 The MWRTA will adopt the definitions contained in Section 26.5 for this program.

 Section 26.7                 Non-discrimination Requirements

 The MWRTA will never exclude any person from participation in, deny any person the benefits of, or otherwise discriminate against anyone in connection with the award and performance of any contract covered by 49 CFR Part 26 on the basis of race, color, sex, or national origin.

       In administering its DBE program, the MWRTA will not, directly or through contractual or other arrangements, use criteria or methods of administration that have the effect of defeating or substantially impairing accomplishment of the objectives of the DBE program with respect to individuals of a particular race, color, sex, or national origin. 

 Section 26.11   Record Keeping Requirements   DOT: 26.11(b)

       We will report DBE participation to DOT on a semi-annual basis, using the DOT “Uniform Semi-Annual Report of DBE Award and Commitments and Achievements”.  These reports will reflect payments actually made to DBE’s on DOT-assisted contracts.

        In accordance with 26.11(d), MWRTA will create a bidders list, consisting of information about all DBE and non-DBE firms that bid or quote on DOT-assisted contracts.  The purpose of this requirement is to allow use of the bidders’ list approach to calculating overall goals.  The bidder list will include the name, address, DBE non-DBE status, age, and annual gross receipts of firms. 

 We will collect this information by:

            1.     Accessing the SOWMBA website, maintained and populated by the State.

2.     Inserting contract clauses requiring prime bidders to report the names/addresses, and possibly other information, of all firms who quote to them on subcontracts;

3.     A recipient-directed survey of a statistically sound sample of firms on a name/address list to get age/size information;

4.     A notice in all solicitations, and otherwise widely disseminated, requests to firms quoting on subcontracts to report information directly to the MWRTA. 

Section 26.13   Federal Financial Assistance Agreement

 

MWRTA has signed the following assurances, applicable to all DOT-assisted contracts and their administration 

Assurance:  26.13(a)

MWRTA shall not discriminate on the basis of race, color, national origin, or sex in the award and performance of any DOT assisted contract or in the administration of its DBE Program or the requirements of 49 CFR part 26.  The recipient shall take all necessary and reasonable steps under 49 CFR part 26 to ensure nondiscrimination in the award and administration of DOT assisted contracts.  The recipient’s DBE Program, as required by 49 CFR part 26 and as approved by DOT, is incorporated by reference in this agreement.  Implementation of this program is a legal obligation and failure to carry out its terms shall be treated as a violation of this agreement.  Upon notification to the MWRTA of its failure to carry out its approved program, the Department may impose sanction as provided for under part 26 and may, in appropriate cases, refer the matter for enforcement under 18 U.S.C. 1001 and/or the Program Fraud Civil Remedies Act of 1986 (31 U.S.C. 3801 et seq.).

This language will appear verbatim in financial assistance agreements with sub-recipients.

On April 13, 2007, FTA issued Circular 4702.1A, "Title VI and Title VI-Dependent Guidelines for Federal Transit Administration Recipients."  This circular provides recipients and subrecipients of FTA financial assistance with guidance and instructions necessary to carry out the U.S. Department of Transportation's Title VI regulations (49 CFR part 21) and to integrate into their programs and activities considerations expressed in the Department’s Order on Environmental Justice (Order 5610.2), and Policy Guidance Concerning Recipients’ Responsibilities to Limited English Proficient (“LEP”) Persons (70 FR 74087, December 14, 2005).

This Circular is effective May 13, 2007.

State statutes mandate that the chief elected official of the community served, or his/her chosen designee serve on the board. In addition, a member representing the disabled community also serves on the advisory board.

The MetroWest Regional Transit Authority Consumer Advisory Committee is a body composed of 12-14 members appointed by the Board of Directors of the MWRTA. This committee will provide for consumer involvement in all aspects of the MWRTA.
